About vehicle agreements
A vehicle agreement records the sale, rental or transfer of a vehicle, identifying it precisely and stating exactly when ownership, risk and insurance responsibility change hands.
Vehicle paperwork fails when the vehicle is not identified precisely, when the odometer disclosure is wrong, or when it is unclear who was responsible for insurance at the moment something went wrong.
Vehicle transfers carry statutory requirements: federal odometer disclosure applies to most sales, and title transfer and registration deadlines are set by each state's motor vehicle authority.

Common mistakes in vehicle agreements
- Copying the VIN inaccurately. The 17-character VIN is what legally identifies the vehicle. Transcribe it from the title or door plate rather than from an advert, and check every character.
- Getting the odometer disclosure wrong. Federal law requires a mileage disclosure on most transfers and falsifying it is a criminal offence. Record the exact reading and note if it is known to be inaccurate or has rolled over.
- Relying on 'as-is' to hide a known fault. An as-is clause covers unknown defects. It does not protect a seller who knew about a fault and concealed it — that is misrepresentation and the sale can be undone.
- Leaving the insurance handover unclear. State the exact moment cover transfers. A gap of even a few hours between the seller cancelling and the buyer starting is a serious exposure.
- Not completing title transfer promptly. Until the title is transferred, the seller may remain on record for tickets, tolls and liability. File the paperwork immediately and keep a copy.
- No record of the handover condition. Photograph the vehicle and the odometer at handover and attach the record. It settles most later arguments about damage in minutes.
Vehicle questions
Does a vehicle bill of sale need to be notarised?
It depends on the state. Some require notarisation for title transfer and others do not, though several accept a signed bill of sale alone. Check your state's motor vehicle authority before completing, since the wrong form can delay registration.
What does selling a vehicle 'as-is' actually mean?
It means the buyer accepts the vehicle in its current condition with no warranty as to faults, known or unknown, at the time of sale. Crucially, it does not licence the seller to conceal a defect they knew about — active concealment can still ground a misrepresentation claim.
When does ownership legally transfer?
Under the contract, ownership passes at the moment the agreement specifies — usually on receipt of cleared funds. For registration and liability, transfer happens when the title is signed over and filed. Complete both, and do not let a gap open between them.
Who is liable if the buyer crashes on the way home?
Normally the buyer, provided ownership and risk have passed and their insurance is in place. This is exactly why the agreement should state the transfer moment precisely and why the seller should confirm the buyer is insured before releasing the keys.
